摘　　要：诉讼契约是诉讼当事人之间意思自治的产物,应具有合法性;当基于诉讼契约而受益的一方提出抗辩时,诉讼契约应对人民法院产生直接的拘束力。人民法院不能武断地认定诉讼契约为无效,或者虽有效但其对人民法院不产生任何的拘束力。The litigation agreement between litigants is a product of autonomy and should have legitimacy. Therefore, when a benefited party in a litigation contract raise a defense, it should have direct binding force on the people＇s court and cannot be ar- bitrarily determined to be an invalid contract, or though effective it has no binding force on the people＇s court.
