摘　　要：制度层面上,我国地下空间开发管理立法缺失,缺乏专门具体的地下空间资源开发管理机构,缺乏整体规划和长远战略。建议:一是建立健全我国地下空间资源开发管理的法律体系,从法律上明确地下空间权,建立我国地下空间开发管理的专门法律,完善地方地下空间资源开发管理的法规体系;二是建立明确具体的地下空间开发专门管理机构,在该机构内明确各个职能部门和下属机构(单位)的管辖范围和执法力度,针对各个地下空间的分支领域进行具体明确的管理;三是对城市地下空间资源的总量、需求量、已开发量以及保留待开发量等数值进行综合研究分析,结合地方发展特色,制定综合的城市长远发展规划。This paper argues that there is neither legislation ＆ organization nor the overall planning and long-term strategy with regard to the underground space resource development and management in China. On this basis, this paper offers that we must establish a sound legal system and local system of rules and regulations. The specialized regulatory body must be established, in which the scope of jurisdiction and law enforcement of various functional departments and affiliated institutions （units） must be defined. In addition, the quantitative value concerning the amount, the demand, developed amount, and the amount of reserved for development of urban underground space resource must be analyzed and studied synthetically. Based on local development characteristics, we must work out comprehensive, long-term development planning of the city.
