论民族区域自治政策实施的基本形式

摘　　要：实行民族区域自治制度是解决中国民族问题的基本政策,是新中国的一项基本国策。民族区域自治政策的实施,是通过民族自治地方自治机关的立法自治权实现的。民族自治地方自治机关有权依法制定自治条例、单行条例、变通或补充法律规定,有权变通执行或者停止执行上级国家机关不适合民族自治地方实际情况的决议、决定、命令和指示。民族自治地方政府行政权力的配置大于一般地方政府行政权力的配置。The implementation of ethnic regional autonomy system is the basic policy to solve the ethnic issues in China. It is also a basic national policy of the new China. Ethnic regional autonomy policy can be put into effect through legislative power of self-government organs of national autonomous regions. Self-government organs of national autonomous regions shall not only be entitled to formulate autonomous regulations, specific regulations, modifications or additions required by law, but also have the right to perform flexibly or stop carrying out higher state organ resolutions, decisions, orders and instructions which are not suitable for the actual situation in autonomous regions. Administrative power of the ethnic autonomous local governments is greater than that of local governments in general.
