摘　　要：人权的普适性、正当防卫制度设立的目的及司法实践的客观需要决定了逆防卫存在的正当性。作为特殊情形下的正当防卫,逆防卫在前提条件、主体条件、限制条件等构成要件上有别于一般情形下的正当防卫;逆防卫在司法实践中的认定与把握也对司法人员提出了更高的要求。It is the universality principle of human rights, the purpose of the establishment of the self - defense system, and the objective needs of juridical practice that determines the legitimacy of the existence of the inverse denfense. As a special ease of self-defense, the conditions of the inverse defense, such as the premise condition, subjective condition, limitation of constitution, and so on, are different from those of the justifiable defense; Juridi- cus are asked more restrictive to identify and deal with the inverse defense in juridical practice.
