中国涉外海洋浮标立法初探——关于制定“中华人民共和国涉外海洋浮标管理规定”的建议

摘　　要：近年来,美、日等国在我环台湾海域的非法测量活动日益猖獗,我国累计发现数十个海洋浮标漂移进入了我专属经济区海域,对我国海洋安全造成威胁,而运用《联合国海洋法公约》的有关规定并不能直接规范和管理。鉴于此,为加强对我国管辖海域涉外海洋浮标活动的管理,为规范国内科研部门与涉外组织在我国管辖海域利用海洋浮标进行的科研活动,我国有必要抓紧制定"中华人民共和国涉外海洋浮标管理规定"。本文仅就相关一般性问题、难点和热点问题开展一些立法探讨。In recent years, the illegal data collection activities by the countries, such as the United States and Japan, in the Pan- Taiwan＇s waters have become increasingly rampant. China has cumulatively discovered tens of ocean buoys entering the exclusive economic zone of China, directly threatening the national maritime security of China. Yet, no direct regulations and administrations are prescribed under the relevant stipulations of the United Nations Convention on the Law of the Sea. In view of this, in order to strengthen the administration of the activities of foreign ocean buoys and to regulate the scientific research activities by the domestic scientific research agencies and the foreign organizations using ocean buoys in the waters under Chinese jurisdiction, China has the urgent need of developing the Foreign Ocean Buoys Administrative Regulation of the People＇s Republic of China. This article will discuss issues, such as the relevant general issues, difficulties, and points of special interests, with regard to the legislation.
