摘　　要：战时缓刑暗含刑事程序法的要旨,需要一个程序运行机制,即战时缓刑的申请、军事法院的宣告和有关机关的交付执行。理论界对战时缓刑的执行和考察机关存在争议,由军队保卫部门负责考察,其他部门和组织配合,比较合理合法。战时缓刑的变更执行程序,包括戴罪立功表现的考察报告程序、军事法院的认定程序和撤销程序。Wartime probation implies a main idea of the criminal procedure law and requires a procedure running mechanism including an application of the wartime probation, declaration of the military court and relevant organic delivery performance. There are many disputes to the executive and investigative organs of the wartime probation in theory circle. It is relatively reasonable and lawful to investigate by military security department and coordinated by other departments and organizations. In aherative executive procedure of the wartime probation there are an investigation report procedure of the ＂offset guilt by merit＂, affirmation procedure and the cancellation procedure of the military court.
