摘 要:业主共有权的实现方式是通过业主大会对区分所有建筑物进行管理,因此保障业主在业主大会中的管理决策权是维护业主共有权的关键。业主管理决策权的内容包括对涉及业主共同利益的重大事项进行讨论和表决、对业主委员会进行监督、对业主大会和业主委员会的不当决议进行制约。为此需要通过业主小组强化业主大会议事多数决的程序保障,采用事中监督、机构化等措施切实实现业主对业主委员会的监督,同时完善业主对业主大会和业主委员会决议的异议权。The homeowner' s right in common is realized through the homeowners' association by managing the con- dominium. Therefore, the protection of the homeowner' s management right is the key to ensure homeowner' s right in common. The homeowner' s management right includes discussion and vote concerning the important items rela- ting to homeowners common interests, supervision of the board of the homeowners' association, and check of the unjustified resolution by the board and the homeowners' association. It suggests that homeowner groups should be designated to provide procedural protection for the homeowner association majority voting, measures such as process inspection and institutionalization should be taken to ensure the supervision of the board by the homeowners, im- provement should be made to the objection right of homeowners concerning the resolution by the board and the homeowners' association.
