行政决策听证议题形成中的公民话语权保障——基于协商民主理论的视角

摘　　要：从协商民主理论视角研讨行政决策听证,公众话语权是贯彻其中的主线。本文认为,行政决策听证议题设置中的公民话语权不仅是对给定议题的发言权,更是提出议题的发起协商权;分析了议题设置的三种模式及公共舆论形成的机理;结合中国实际研讨民意集结以及民意议题化所需的制度条件:前者主要是从政策和制度上发展并拓展社团组织及其活动的空间,并对连接阅读群体的传媒权力加以调节,后者主要在于通过听证议题设置的程序规定赋予公民程序性权力,用程序正义排除权力和资本的干扰,以保障公民在议题设置中的话语权得以真实兑现。Civil discourse fight is a key for researching administrational decision -making hearing by deliberative democracy theory. This paper proposes that civil discourse fight should include right of discussing and originating issues, then it analyses three models of issues setting and its mechanism and institutional condition of public opinion forming in China. The models and mechanism pay more attention to kinds of public polices as to how to develop and exploit the associations＇ public sphere and regulate the power of traditional medias. The institutional condition mainly focuses on how to build a kind of procedure justice to eliminate interference of power and capital through creating procedure of public hearing issues setting for protecting the civil discourse right in issues setting.
