论我国社区矫正对象权利的法律保障

摘　　要：目前,我国社区矫正对象权利法律保障方面存在立法不足、执法不力、司法实践难以真正落实和缺乏强有力的法律监督等问题。将来在制定《社区矫正法》时,既要规定社区矫正对象权利的具体内容,又要考虑到实践中的可操作性;提高社区矫正工作者的执法素养很有必要;同时,可以从完善立法、更新理念、落实职责、丰富手段和建立谈话制度等方面完善社区矫正对象权利的法律监督机制。At present,there are problems of our community correction object rights in legal protection,such as the shortage of legislation,inadequation of law enforcement,no truly implement of the judicial practice,and the lack of forceful legal supervision.In the future,when we make the＂community correction law＂,we should provide the specific content of community correction object of rights,but also take into account the operational practice.It is necessary to improve the law enforcement quality of community correction workers.Meanwhile,we can improve the legal supervision mechanism of community correction object rights through the following aspects：to perfect the legislation,to renew the ideas,to implement the duties,to enrich methods,and to build talking system.
