摘　　要：防治有组织犯罪倾向于刑事法治的侧面,而行政法治的侧面往往重视不够。国内外司法实践经验教训告诉我们,要运用法治思维和法治方式对社会进行管理,在有组织犯罪防治方面应当从思想理念上树立社会防卫与人权保障并重的法治理念;从执法策略上贯彻打防并举、重在预防;从方法措施上深入加强国内和国际执法合作;从执法体制上改革和完善行政执法体制特别是公安行政执法体制。The traditional underworld nature crime prevention tends to the criminal side of the rule of law,but the administrative rule of law in the fight against the underworld nature crime is an another important aspect that can not be ignored.The core of the rule of law in the current administrative is reform of the administrative law enforcement system,particularly the reform of the public security administrative law enforcement system.To reconstruct the administrative law enforcement organizations,and to adjust the administrative enforcement power,and to construct the administrative law enforcement and security system is conducive to comprehensively promoting the rule of law and preventing the underworld nature crime in more depth.
