摘 要:目前我国国有土地年租金立法征收标准过于单一,租金调整的条件局限于定期评议,租金调整的程序制度缺失,租金的减免制度尚未完全建立,租金交纳义务违反的责任徘徊在行政责任和民事责任之间。上述问题严重影响了国有土地年租制效能的发挥。应当将地价还原率作为租金标准之一,建立"定期评议+法定事由"的租金调整机制,建立租金调整的程序制度,健全租金减免制度,将租金交纳义务的违反责任性质界定为民事责任。Nowadays, the legislative standards for China's state-owned land annual rent are too simple, the rent adjustment conditions are confined to regular review, the rent adjustment procedure is deficient, the rent reduction and exemption system has not been fully established, and the liability for breaching rent payment duties goes between administrative responsibility and civil responsibility. All these problems have seriously affected the functioning of the state-owned land rent system. Therefore, it is essential that land reduction rate should be adopted as part of the legislative standards, the rent adjustment system involving regular review and legal reasoning should be established, the rent adjustment procedure should be set up, the rent reduction and exemption system should be improved, and the liability for breaching rent payment duties should be defined as civil responsibility.
