摘　　要：伤病残退伍军人伴随美国不断的对外扩张战争已经成为美国重要的群体,对其权益的保障影响着美国募兵制的实施。美国法律将伤病残退伍军人分为两类:与服役有关的伤病残退伍军人、与服役无关的伤病残退伍军人,并进行了较为细化的身份法律界定,理论上,伤病残退伍军人首先应该享有退伍军人应该享受的货币福利、政治待遇、教育就业优待等,但在司法实践中,美国伤病残退伍军人权利的种类及其适用有其特殊之处。The Disabled American Veterans has become one of the important groups in the American society,along with expansion of its military influence overseas.The degree of protection of their benefits affects the implementation of recruitment.According to Federal reterans Law,rules and regulations,the disabled veterans are divided into Service—connected disability and Non—Service— connected disability,and a more detailed legal definitions of identity are included.In theory,the disabled veterans should be entitled all the benefits which common veterans enjoyed,but in judicial practice,the scope and application of The Disabled American Veterans benefits have its own charateristics.
