摘　　要：苹果公司的在线应用程序商店App Store存在侵权风险,其法律地位应当界定为网络交易平台而非信息存储空间。可从是否设置合理的"通知-移除"机制、直接经济获益、侵权信息的明显程度和商业模式的合理性等因素认定App Store的版权侵权过错。App Store operated by Apple Inc. is found to have committed copyright infringement, which should be legally def＇med as network transaction platform rather than information storage space. The rules to recognize the fault of copyright infringement of App Store include： whether a reasonable ＂Notice-Remove＂ system is established, whether direct economic benefit is obtained, whether infringement information is obvious and whether trade models are reasonable.
