南非矿业投资法律制度浅析

摘　　要：近年来,南非通过一系列优惠政策,以吸引外商投资国内矿业。文章从南非的矿业权管理体系、外商投资法律制度和影响投资因素3个方面,系统阐述了南非矿业投资的相关法律规定,为境外投资者提供了投资南非矿业的法律信息。由于南非矿业投资面临法律不清晰、电力短缺等政治、经济风险,建议国内企业聘请有强大分支机构的当地专业咨询机构,做好投资前的可行性分析,这样将有助于降低投资风险。South Africa adopt a series of preferential policies to attract foreign investment in domestic mining industry in recent years. The article introduces the relevant laws and regulations of mining investment in South Africa systematically from the following aspects ： management system of mining rights,the legal system of foreign investment and the impacting factors of foreign investment,and provides legal information for foreign investors. Due to the blur lawful system and shortage of the power supply, therefore there are political and economic risks for foreign investors in the mining industry in South Africa to some degree. It is suggested that the domestic enterprises hire the local professional consulting organization with well - known reputation conduct the project feasibility analysis report before investment in order to reduce the investment risk.
