侵权责任方式的理解与适用

摘　　要：中国《侵权责任法》规定了八种侵权责任方式。侵权责任方式具有多元化、救济性等特点。侵权责任方式的适用应该考虑特定条件、侵权法的社会功能等因素。中国侵权责任方式的规定,解决了一些有争议的问题,如是否规定损害赔偿以外的责任方式、侵权请求权与物权请求权的关系等。The Tort Liability Law stipulates eight methods of bearing tort liability. The methods of beating tort li- ability have characteristics of diversification and remedy. The application of methods of bearing tort liability should consider specific conditions and social function of tort law. The methods of beating tort liability can re- solve some controversial issues, such as whether formulate the responsibility besides damages, the relationship between tort claim and tight claim.
