论我国老年人赡养法律制度的完善——基于新旧《老年人权益保障法》的比较

摘　　要：新《老年人权益保障法》比"旧法"有了比较大的调整,明确了精神赡养的内容,将赡养由子女的义务拓展为父母的权利,是立法上的重大突破,但是仍然有一些问题需要明确和完善。物质上的赡养、生活上的扶助以及精神上的慰藉是家庭赡养制度的核心内容。通过比较国外成熟养老制度和模式,并结合我国赡养制度的实际情况,提出一些可行性建议。The new ＂Law on Protection of Rights and Interests＂ has relatively large adjustments. It makes clear content of spirit maintenance, expands supporting parents into parental rights. It is a major breakthrough in legisla-tion. there are still some problems need to be clear and perfect. The material comfort are the core content of the family support system. tem and model, and combined with the actual situation feasible suggestions.
