摘　　要：在我国铁路改革发展的新形势下,需要对铁路车票所构建的客运契约订立、实施过程及违约救济进行优化设计。借鉴国外铁路车票管理经验,从我国铁路车票涉及的契约三方——承运主体、监管主体及旅客角度探讨效率优化的措施,即通过承运方改善契约订立信息环境、灵活铁路客运契约产品设计、平衡交易双方权责;监管方居间谈判制定交易规则、构建区分化价格形成机制;旅客明确车票的契约合同属性及不同效力,共同促进车票契约效率的优化。Under the new status of railway reform and development in China, the setting up and implementing process as well as breach and relief of passenger transport contract established for railway tickets need to be taken optimization design. By referring the practices of railway ticket management in foreign countries, this paper discusses the measures on efficiency optimization from the contract three parties involved in Chinese railway ticket, which are the carrier body, regulator body and passenger, the way means carrier party could improve the information environment of contract setting up, make the contract product design of railway passenger transportation more flexible and balance the authority ＆ responsibility of both parities to the transaction; regulator body mediates, negotiates and institutes transaction rules, and also establishes divisional price as to form price mechanism; passenger defines the contract property and different effect of ticket, and promote the efficiency optimization of ticket contract together.
