法治评估与法治创新——基于浙江余杭实践的讨论

摘　　要：余杭法治评估的创新首先在于它以个案性、政治性、社会性和动态性四个特征,展示了法治评估实验在"法治先发地"的成功;其次,其开创的"中国特色的第三方评估"模式,由专家主导、政府推进,引入"利益相关者"共同参与评估,从多源头获取评估信息,为其他地区、部门推广与应用评估体系推进法治发展树立了标杆。今后,应进一步强化对法治精神与内涵的准确界定,改进评估方法,提炼余杭法治的成功要素,培育"从评估到优化"的法治绩效理念。唯此,才能最大限度地发挥余杭经验的示范效应,带动全国范围内的法治发展。The innovation in Yuhang’s appraisal of rule of law firstly lies in that,as aunique political and social case,it displays the success of the experiment in evaluating rule of law in the place of origin.Secondly,the mode of'the third-party evaluation with Chinese characteristics'initiated by Yuhang was promoted by experts and the government,with the involvement of the stakeholders and information from various sources,setting agood example for other areas and sectors.In the future,efforts should be made to define the spirit of rule of law,improve methods of appraisal,summarize the successful experiences of Yuhang,and develop aconcept of performance evaluation,i.e.to improve through evaluation.Only by doing so can we give the fullest play to the exemplary role of Yuhang’s experiences and promote the development of rule of law nationwide.
