预先设置防卫装置行为的刑法审视

摘　　要：预先设置自动防卫装置在何等条件下成立正当防卫,理论界研究不多,观点不一。因预先设置自动防卫装置具有特殊性,只有在满足特定条件的情况下此等行为才能成立正当防卫,具有合法性。惟如此,才既可以保障公民在特定情况下享有正当防卫权,又不至于使得私权过于膨胀至无边无沿,从而有利于和谐社会秩序的维护。When it comes to the conditions under which the pre-set of the automatic defense device can be re-garded as justifiable defense, the studies are few among the theorists and the viewpoints are varied. This paper argues that the pre-set of the automatic defense device has its particularity and can be treated as justifiable de-fense with the legality only when the certain conditions are met. Only in this way can the citizens＇ rights of justi- fiable defense be guaranteed under the certain conditions while the private rights can also be restricted within the contributing to the maintenance of the harmonious social order.
