摘  要:《中华人民共和国海事诉讼特别程序法》第97条对中国油污损害赔偿中的直接诉讼制度作出了一般性规定,但由于立法技术的缺失,该条规定的性质及适用范围在实践中仍存在较大争议。直接诉讼的理论基础在于合同相对性的突破,即赋予受害人对保险人或财务保证人以直接的损害赔偿请求权,是中国立法在借鉴《1969年国际油污损害民事责任公约》基础上形成的实体法制度。在司法实践中,其适用范围应当包括《2001年国际燃油污染损害民事责任公约》下受害人对保险人或财务保证人的直接诉讼,以维护受害人的权益进而增进社会公益之保障。Article 97 of Maritime Procedure Law of the People's Republic of China makes general provisions for direct action in oil pollution damage. However, there are great disputes on the nature and application scope of this article due to lack of complete and perfect legislative techniques. Based on related theory, the theoretical basis of direct action is the breakthrough of privity of contract, in other words, the victim is entitled to make a direct claim against the third party of contract. Particu- laxly, direct action under Chinese law is a substantive law system by using the International Convention on Civil Liability for Oil Pollution Damage, 1969 for references. But in practice, the application scope of this article shall include the application scope stipulated in International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001. Only by this can the court protect the rights and interests of victim and promote the protection for public interests at the same time.
