摘　　要：宅基地使用权是指农村村民在农村集体组织所有土地之上,建造和保存住宅及附属设施,并对其行使占有、使用的用益物权。宅基地使用权消灭的主要原因是宅基地长期闲置、自然原因。消灭的法律后果,体现在宅基地上的住宅及其附属设施的转让权、购买权与重新再分配的权利。农村宅基地的重新再分配,应以公法保障与限制原则、平等保护原则、合理规划、提高土地利用效率原则为基本原则。Homestead use right refers to the rural villagers in the rural collective organization of all land, construction and preservation of residential and ancillary facilities, the usufruct of possession, use. The main reasons for the homestead use right to be liminated are left unused for a long time, natural causes. The legal consequences extinguished, reflected the house in the homestead and transferring rights of ancillary facilities, the right to buy and redistribution rights. The redistribution of rural homesteads, should be based on the principle of equal protection, public security and restrictions, reasonable planning, improving the efficiency of land use.
