制定《国家公职人员财产申报法》若干问题的思考

摘　　要：财产申报法号称"阳光法案",是反腐败的终极利器,因此,制定专门的《国家公职人员财产申报法》不仅必要而且可行。《国家公职人员财产申报法》的内容应当包括总则性规范、申报主体或申报义务人、申报财产的范围、申报种类、申报受理机关和申报审查机关、申报受理程序和审查程序、申报书的公开和法律责任等。《国家公职人员财产申报法》立法应当强调个人财产登记实名制及其技术手段的运用,要处理好公开与隐私的关系,使立法与相关法律制度配套。Property declaration law known as the ＂Sunshine Act＂,is the ultimate weapon of anti-corruption,formulate special ＂national public officials to declare the property law＂ is not only necessary but also feasible.＂Property declaration law＂ of the content should include general specification,the main reporter,declare property scope,nature,declaration accepting organ and declaration review authority,application and review procedures,the declaration of public and legal responsibility.The legislation should pay attention to personal property registration system and the technical means to declare the law,to deal with public relations and privacy,attention should be paid to supporting legislation and related legal system.
