摘　　要：在专利侵权纠纷案件中,专利默示许可现已发展成为一种新的侵权抗辩事由。然而,我国现行法律对此没有明确规定。文章试图分析专利默示许可的理论基础、产生情形、具体内容,以期对我国专利默示许可制度的构建提出一些建议。In the case of patent infringement disputes,paten implied license has become a new tort defense, but there is no definite law in China＇ s current legal system. The analysis in this paper concerns the theory base, background, and content of the patent implied license to provide a reference for this system in China.
