加强人大对企业国有资产监督的思考

摘　　要：企业国有资产监督包括出资人对国有企业经营管理行为的监督和人大对监督人监督行为的监督,这是两种不同性质的监督形式。目前相关法律已经对前者的监督主体、监督内容和监督方式作了明确规定。但对后者的监督内容和监督方式规定得过于简单,致使人大对企业国有资产的监督流于形式,缺乏监督刚性。因此,应在人大常委会下设立专门机构,加强人大对企业国有资产的监督。Supervision of state - owned assets of enterprises including the investors＇ supervision on the operation and management of state - owned enterprises and the supervision of the National People＇ s Congress to supervise the investor behavior, these are two different nature of the supervision form. Current laws already on the subject of supervision, contents of supervision and way of supervision to make the explicit rules for the former. However, in the latter the content and the way of supervision of the provisions are too simple, so that the people＇ s Congress supervision of state - owned assets to become a mere formality, the lack of supervision and rigid. Therefore, we should set up specialized agencies in the NPC Standing Committee, to strengthen the supervision of state - owned assets of enterprises.
