法家势治思想——兼论合法性视角下权势的作用

摘　　要：在专制主义政体中,先秦时期法家势治思想强调的权势对建立政治合法性有积极作用,但同时认为权势不是万能的;权势是法家势治思想的核心,跳出势治思想产生的先秦时期,在以后的民主政体中,政治合法性的获得对权势的要求并没有完全夭折,只是变化和弱化了。This article consider that the legalist school＇s thought for power rule had a positive influence on setting up a political rule valid under autocracy＇s system of government in the pre-Qin period, but meanwhile consider that the power is not omnipotent;Power is the core of the legalist school＇s power rule,out of the pre-Qin period which thought for power rule came into being.ln the different system of government backward,the acquirement of legality which claim about the Dower is still there,.iust be chanqed and weakened.
