文化创意产业知识产权保护法律问题研究——以北京市为例

摘　　要：现阶段北京市文化创意产业知识产权保护中存在的主要问题包括立法规定有待完善;行政查处力度有待加强;权利人通过诉讼途径维权的成本较高;权利人自力救济的意识和能力不足等。因此,今后应当着眼于加强法制宣传,提升全社会的知识产权保护意识;加强地方立法,促进文化创意产业知识产权保护有法可依;完善体制机制,强化文化创意产业知识产权行政保护力度;完善多元机制,提高文化创意产业知识产权纠纷的解决效率;发挥行业指导作用,提升文化创意企业自我保护能力。The main legal issues of intellectual property -protection in Beijing＇ s cultural and creative industry include： the legislation should be perfect; the administrative supervision needs to be strengthened; the IPR holders afford high cost through litiga- tion approach; the IPR holders＇ self- protection need improve. In order to solve these problems, the legal promulgation should be strengthened to enhance the awareness of public ; local legislation should be strengthened to assure protection work has regulation follow; the system and mechanisms should be improved to strengthen administrative protection; multiple mechanisms should be estabhshed to improve efficiency of disputes settlements; and the role of industry guidance should be played more to promote the self - protection of cultural and creative enterprises.
