摘 要:《中华人民共和国海域使用管理法》并没有规定闲置海域使用权无偿收回制度,该制度目前主要散见于地方性法律规范之中。公共利益重大关联是设定海域使用许可持有人如期开发利用海域义务之利益要素,而"后行政许可义务"则是海域使用许可持有人如期开发利用海域义务之基本责任属性。闲置海域使用权无偿收回法律制度的运行能够形成一种集守法倒逼机制与海域使用许可退出机制于一体的海域使用许可后续监管机制。闲置海域使用权无偿收回制度的完善须以解决制度设定主体、闲置期限认定、程序性质定位、程序结构构造四个方面的标准问题为支撑。The institution of gratis revoking the use right to idle sea areas is not included in the Law of the People' s Republic of China on the Administration of the Use of Sea Areas, but can be found in some local regulations. Admin istrative license holders with the right to use the sea areas are obligated to duly develop and utilize them, in which the important public interests are involved. In other words, the license holders are under a "post licensing obliga tion", in which their primary responsibility lies. In the realm of administrative licensing concerning the use of sea ar eas, the operation of gratis revoking the use right to idle sea areas can build a subsequent supervision mechanism that integrates "back driven" law obeying mechanisms with administrative license exit mechanisms. And in or der to perfect this legal system, we need to solve four fundamental problems : Who has the right to revok the use right to idle sea area? How long shall an "idle period" be defined? What' s the nature of this legal system? And how shall the legal processes be constructed?
