摘　　要：跨行政区流域生态补偿关系主体多元,而且主体间具有网络化特性、交互性、内容多样性。流域生态补偿之所以必要,其核心原因在于流域经济、社会和环境要素结构不平衡,流域不同区位利益分享或流动机制失范。社会性属性应该是生态补偿尤其是跨行政区流域生态补偿的本质属性,跨行政区流域生态补偿本质上是发展权益补偿和平衡。跨行政区流域生态补偿法律机制建构应该突出社会性的"约定"机制。"约定"机制符合社会规律与实践经验、是程序性机制、是跨行政区流域生态补偿利益相关者的广泛参与机制。"约定"机制需要配套机制建设,尤其是国土功能规划以及产业发展布局规划机制、流域信息交流机制、流域生态价值评估机制等。The inter-jurisdictional river basin ecological compensation ecologlcat compensation relations subject pluralism, and with networking, interactive features, content diversity among sub jects. River basin ecological compensation is necessary, the core reason is that economic, social and environmental elements structure imbalance, anomie share or flow mechanism of the interest of the basin in different location. Across the region of river basin ecological compensation in essence is akind of social environmental protection measures, is the development of equity compensation and balance. Across the region river basin ecological compensation legal mechanism construction should highlight the ＂convention＂ of social mechanism. ＂Convention＂ mechanism conforms to the social law and practice experience; Is the procedural mechanism; Across the region river basin ecological compensation mechanism of the participation of stakeholders. ＂Convention＂ mechanism need to form a complete set of mechanism construction, especially the land function layout planning and industrial development planning, watershed information exchange mechanism, ecological value evaluation mechanism, etc.
