摘　　要：《全国人民代表大会常务委员会关于加强网络信息保护的决定草案》较之以前出台的规定,没有实质上的突破,且标题与内容的不一致显露出立法不严谨。立法应摆脱"高位阶立法更有效"的惯性思维模式;严格法律概念的表述,消除大众化、口语化倾向;厘清网络管制的标准,明确政府管理的权限;严格限定网络服务提供者收集用户个人信息的范围;建立高效便捷的维权机制,侧重于网络管制与众多网民身份信息与隐私的保护。Compared with early regulations, Decision of the Standing Committee of the National People＇s Congress on Strengthening Information Protection on Networks, has no substantial breakthrough. The title and the content are inconsistent, showing the legislation is not so strict. Legislator should focus on the protection of network control and netizens＇ identity information and privacy through the following five ways： getting rid of the conventional thinking mode of ＂ higher legislation, more effective＂, strictly formulating legal concepts and avoiding using legal or colloquial concepts, clarifying network control standards and limits of govern- ment authority, limiting the range of personal information collection, and building an efficient and convenient mechanism to guard rights.
