摘　　要：本文从经济学的角度 ,研究刑法中刑罚、犯罪的成本与效益的关系、探求怎样用有限的刑罚资源 ,发挥最优的刑罚威慑效果 ,从而达到以最少的刑罚资源达到最优的社会效益。The article, in the light of the relationship between the cost of the penal punishment and benefit of the commitment of crime, probes into the problem of how to attain the greatest deterrent effect with the limited penal resources so as to reach the best social effect through least penal resources.
