摘　　要：档案部门在进行网站保存活动过程中会遇到一系列的法律问题,例如现有法律的限制、不完善的立法等,这些都妨碍了网站保存的顺利开展。文章将对策效力的时间性作为切入点,提出了两种解决之道,即权宜之计与长久之计。概括起来,权宜之计为遵守robots协议、先采集,后补救、与版权所有者协商;长久之计为完善现有相关法律法规、推进网络信息资源保存的立法。The archives department will encounter a series of legal problems in website archiving, such as the limits of existing laws and imperfect legislation, which will hinder the web archiving smoothly. In this paper, the timeliness of the countermeasures is the cut point, putting forward two solutions including the expedient solution and the permanent solution. In a word, expedient solution is compliance with the robots protocol, the first acquisition follow the remedy, and consultation with the copyright holder; the long-term strategy is improving the existing laws and regulations and promoting the legislation of web archiving.
