摘 要:社会法的"逆向"生成在一定程度上是"恶之花"结出"善之果"的过程。近代西方社会在发展过程中产生了民生保障缺乏之"恶"、分配之"恶"和制度之"恶"等重大社会问题,社会法正是在这些"恶之花"的基础之上生成的"善之果":民生保障缺乏之"恶"造就保障之法;分配之"恶"催生矫正之法;制度之"恶"呼唤改良之法。社会法之生成根植于其生成基因:在伦理层面上仰赖于恶对善的集体"妥协";在制度层面上起始于社会法之独特优势;在社会物质基础上因应社会发展中的民生问题。社会法之生成是合规律性的产物:在伦理维度上符合人性中"恶"向"善"转化的规律;在哲学维度上符合辩证法的规律;在社会维度上符合社会发展的规律;在规范维度上符合法律自身发展的规律。To some extent , the social law' s reverse generation is a kind of progress through flowers of evil to good fruit. It is rooted in the social ills closely connected to the dynamics of modern western society, in particular, the unfair allocations, inade quate livelihood and distorted social system. The social law is the virtuous outcome as good fruit returned by social injustice in context. It is livelihood where the necessities of life unsecured claimed law to promote social security whilst allocation in the ab sence of fairness requested rectification and distorted social system appealed to amelioration. Accordingly, its generation is estab lished by virtue of the upshot of collective compromise to goodness at the level of moral, relies on peculiar institutional advantage besides being as a prompt response to livelihood issues in the field of economic infrastructure. Furthermore, this mechanism of generation is in line of reason by bringing to completion of the inclination of transfer to goodness inherent in humanity, the classic dialectic model of change, the inherent rules of social progress, along with the norm of legal development.
