摘　　要：体育自治的实质是作为体育社会团体法人的全国单项体育协会的内部自治。体育自治始源于中世纪西欧城市和行会的自治形式,在此基础上发展成符合现代体育行业内部管理本质要求的一种组织原则。目前,全国单项体育协会在法律上已被界定为具有独立法人资格的社会团体,使体育自治在自治主体上获得了法律保证。此外,全国单项体育协会的治理职能具备多重性——集政府职能管理、社会团体法人自律、企业经营活动于一身,其自治权根源于改制前之体育行政权,但已与后者划清界限。再者,全国单项体育协会拥有独立的内部纠纷解决机制,"用尽内部救济原则"保证了体育自治在一定限度内的充分实现,国家司法权不轻易干涉体育行业内部纠纷处置权。因此,全国单项体育协会从立法、行政和司法上为其自治打下了坚实的基础,能够保证我国体育管理体制改革的顺利推进和各项目的健康发展。Sports autonomy is essentially the internal autonomy of State Association of Single Sports as juridical sports association. Originated from the autonomous forms of the medieval western European cities and trades, it has developed into a kind of organizational principles which conform to the essential requirement of internal management in modern sports industry. At present, State Association of Single Sports is defined in law as an association with independent legal personality, thus allo- wing sports autonomy legal guarantee. Moreover, State Association of Single Sports bears multiple administration functions： integrating as a whole administration of government functions, self - discipline of juridical association and management of enterprise activities. Its autonomy right stems from sports administration right, thereafter dividing from it. Besides, State Asso- ciation of Single Sports owes independent mechanism of internal dispute settlement, and its ＂Exhausting the Internal Relief Principle＂ guarantees sports autonomy to some extent. State jurisdiction does not interfere easily its right of internal dispute settlement. Therefore, State Association of Single Sports gains, in law, administration and jurisdiction, a solid foundation for its autonomy, which ensures the smooth advances in sports management reform in China and the healthy development of all sports events.
