摘 要:行政决定的效力本质上是不同社会主体对行政决定创设的权利义务所负担的特殊法定义务,可分三个方面:其一为基于行政程序的进行行政决定所取得的效力,是程序价值在行政决定效力上的体现;其二为基于法律评价行政决定应具有的效力,是法律和正义观念在行政决定效力上的体现;其三为法律与社会变迁对行政决定效力的影响,是情势变化对行政决定效力作用的结果。前者旨在保障行政机关积极形成行政法律秩序,后两者旨在维护法治与正义,保障私人合法权益或新生公共利益。In nature the administrative decision effectiveness is the specific legal obligation undertaken by different social subjects to the rights and obligations set by the administrative decision, which can be divided into three aspects, i.e. the first one is the effectiveness gained by the administrative decision on the basis of administrative procedure, which is the embodiment of procedure value on the administrative decision effectiveness; the second one is the effectiveness should be gained by the administrative decision based on legal evaluation, which is the embodiment of the law and the justice concept on the administrative decision effectiveness; the third one is the influence of legal and social changes on the administrative decision effectiveness, which is the result of situation changes on the administrative decision effectiveness. The former one aims at guaranteeing the administrative organ to actively form the administrative legal order, while the latter two aim at maintaining rule by law and justice as well as guaranteeing the private legitimate right and interest or newborn public interest.
