摘　　要：文化法制建设任重而道远,这不仅是构建我国法制体系的基本需要,也是一种权利回归和真实化的体现,更是构建文化强国的一种必须。文化法制建设遵循其他领域法制建设的基本路径,研究环节始于其基本理论终于文化法制的执行。在整个过程中必须以文化为基本的逻辑出发点,对文化基本问题的研究就成了文化法制建设的基本理论前提。文化具有自由性、整合性、社会性和经济性等基本特征,这些特征贯穿文化研究的始终,对这些问题的深刻研究有利于对文化进行系统和深入的探讨,从而为文化的法制建设的规范性、科学性奠定坚实的基础。The legal construction of culture is the basic needs of constructing China~ legal system, is a kind of right to return and the real manifestation, and a must for the building of a powerful cultural country. The legal construction in culture follows the general path of legal construction in other areas, which begins in the basic theories and terminates in the enforcement of cul- tural law, with culture as its starting logical point in the whole research process. Therefore, the study of the basic issues in cul- ture has become a theoretical precondition. Besides, culture is free, integrated, social and economic, which goes through cuhur- al studies. Hence, the deep study of these features will be conducive to a comprehensive and profound exploration of culture, so as to lay a solid foundation for the normative and scientific legal construction of culture.
