国家行为与村民自治的关系探析

摘　　要：本文尝试对国家行为与村民自治的关系问题予以初步的学理研究与讨论,思考的重点是国家行为应当如何调整才能促进村民自治向更加完善的状态发展,并在推进农村现代化的进程中发挥更大作用。本文认为,作为一项政治制度的村民自治具有特殊性,是当代中国糅杂地方自治和民主政治特点的农村政治模式。现阶段我国村民自治制度存在的典型问题包括:村委会与乡镇政府的关系变化、"两委"的矛盾和冲突、村级治理中的"选举乱象"和村务荒废等。未来中国的乡村社会转型和村民自治的发展必须通过国家行为来推进,这种推进绝非事无巨细的全面统制,而是宏观的规划、设计与较为具体的指导以及制定良好的法律制度。This article tries to give the preliminary the relationship between national behavior and the tional behavior should be adjusted to promote the more perfect. This paper argues that, the Village theoretical research and discussion to the problem of Village Self- governance, focusing on how the na- development of the Village Self- governance to be Self - governance which is a political institution has its particularity. It is the rural political model that mixing the characteristics of the local autonomy and democracy. Typical problems of the Village Self - governance system in our country at present stage in- clude： the relationship between the villagers committee and the towns government; the conflicts and contradictions between ＂two committees＂ ; the elections ＂ chaos＂ in villages committee, etc. The fu- ture of Chinag rural social transformation and the development of the Village Self - governance must be promoted through the national behavior. This kind of promotion does not mean the overall control of eve- rything in village, but the guidance of macro planning, designing and a more specific and set a good le- gal system.
