摘　　要：在一个资本自由流动的开放市场框架内,规制市场竞争行为,必然要以资本本身的发展研究为前提。无论何种模式的市场秩序,都应该最终指向国际垄断资本为核心的结构性市场竞争关系。没有国家强制权力的合理化、专门化,就没有现代意义上的市场秩序,行使国家强制权力的"政府干预"是市场秩序赖以存在和发挥作用的必要条件。因此,罔顾国际垄断资本的行为方式和权力版图,抽离基本、关键的结构要素所设计的"竞争性市场",无非是对"自由市场"的"中国特色式"解读和构想,是湮灭历史和现实的市场乌托邦。In an open market environment where capital unrestricted flows, for ruling and regulating the competition behavior in the market, the necessary prerequisite is to research and recognize the development of the capital. No matter what kind of market order, it eventually links to the market competing relationship, the core of which is international monopoly capitalism. If there is no rationalization and specialization of state-coercive rights, there is no market order in the contemporary sense. The government intervention is the necessary condition that the market order can exist and work smoothly. Somebody designed a style of ‘competitive market', which dose not only take no behavior pattern nor the influence sphere of international monopoly capital into account, but also pulling away the basic and crucial structural elements. But it is no more than an interpretation and conception with Chinese characteristics for the free market, and a Utopia which makes history and reality into dust.
