拉丁美洲能源合作开发争端解决机制研究

摘　　要：在分析拉丁美洲能源合作开发及争端解决实例的基础上,总结出拉丁美洲能源合作开发争端解决的不同类型,即对于拉丁美洲区域内的能源合作开发争端以和平协商方式解决,而在与拉丁美洲区域外的能源合作开发争端中,政治对抗则为常见手段,可见在解决能源合作开发争端上拉丁美洲并没有形成一定的体系,其处理方式具有很强的任意性,这在一定程度上阻碍了拉丁美洲能源合作开发的顺利进行,因此,拉丁美洲区域内建立能源合作开发争端解决机制是十分必要的。This article summarizes the different types resolving the disputes in the Latin America energy cooperation on the basis of analyzing the examples in the joint developments and disputes resolution of the Latin America energy cooperations. That is, the energy joint developments and disputes of the Latin America are usually resolved with peaceful methods, but the political confrontation is generally used in resolving the disputes in the energy coopera- tions with the areas outside the Latin America regions. It can be seen that there is no particular system in resolving the disputes of the energy joint cooperation for the Latin America and the approaches show strong arbitrariness which put off the energy joint developments of the Latin America to a large extent. So it is necessary and essential for the Latin America to build the dispute resolution system of the energy joint developments.
