我国《公务员法》抵抗权条款之研究

摘  要:通过对我国抵抗权制度的深入分析,认为我国公务员抵抗权制度对决定和命令的范围、错误与明显违法的界限界定不清,导致适用困难。因此,应该规定公务员可以抵抗上级发布的抽象行政行为;上级在发布决定和命令时必须采用书面形式,便于公务员在发生抵抗权争议时取证,有利于公务员保护自身权益;应对明显违法的标准采取列举式和排除式的规定,明晰二者之间的界限,使公务员较好地作出是否行使抵抗权的判断。The system of disobedience has some problems on the range of the decisions of the superiors, the boundaries between " obvious illegal" and " mistake" is vague by analyzing thoroughly the right of disobedience. Therefore, civil servants can resist the abstract administrative acts; the written form will be set when the superiors make decisions and orders, which is helpful to obtain evidences " obvious illegal" is set by using listing and exclusionary the right of disobedience. and protect the interests of civil servants ; the standard of rules, which make civil servants judge rightly the use of the right of disobedience.
