摘 要:体育赛事转播权是体育组织重要经济来源,至今,人们对体育赛事转播权的法律性质界定众说纷纭。采用文献资料、逻辑分析等方法分析体育赛事转播权的法律性质、权利归属,通过对国内外专家赛事转播权法律性质分析,研究认为:体育赛事转播权应分成"直播权意义上"的转播权和"字面意义上"的转播权两个部分,前者是体育组织拥有的转播权,它是一种商品化权,接受《合同法》保护;后者是电视台和新媒体机构拥有的转播权,它是一种广播组织权,接受《著作权法》和《信息网络转播保护条例》等法律法规保护。最后提出完善我国体育赛事转播权法律制度的几点建议。Sports broadcasting right is an important economic source of sports organizations, whose legal nature has not been clearly defined. In this paper, the legal nature and the right attribution of sports broadcasting right were an- alyzed, countermeasures were proposed and it held that the right should be divided into two parts. One is the broad- casting right from the perspective of live broadcast and the other is the broadcast right on paper. The former belongs to the sports organization, which is a kind of merchandising right, protected by the Contract Act. The latter means that television and new media agency own the broadcast rights, which is a kind of right of broadcasting organization, protected by Copyright Act and the Regulations for the Protection of lnformation Network Transmission and other laws and regulations.
