成绩资本产权的主要现实表现形式及法律思考——以我国专业运动员为视角

摘　　要：自1978年《体育运动国际宪章》明文规定体育运动是每个人的权利开始,体育作为公民的权利已形成共识。尽管我国法律没有明确作出规定,但是作为专业运动员权利表现形式的人力资本产权问题已经受到了体育界和法学界的关注。研究认为,成绩资本产权是指专业运动员在比赛中由其运动天赋与运动潜能而取得的优异运动成绩所带来价值增值的价值,是运动员作为民事主体依法享有的人身权利以及与人身权利相关的经济利益的占有、使用、收益、处分等权利。目前,我国专业运动员转会、商业活动和奖金分配等问题都涉及成绩资本产权问题,因而有必要从法律的视角找寻解决问题的路径。Since 1978, International Charter of Physical Education and Sports specifies that sports are the right of every person. In China, professional athletes＇ performance capital property right, which means the increment of the value brought by the excellent sport achievement of professional athletes in the sports games, which means that the athlete as civil subjects are legally entitled to the rights of the person and personal rights of the economic benefits re- lated to the usage, income, punishment right, has been under concern of the sports and legal fields. The transfer, commercial activities and bonus distribution of the professional athletes all involve the legal solution of performance capital right.
