摘 要:传统上,我国一直强调国家利益、集体利益,漠视个人利益,忽视公共利益。从应然上讲,政府除了代表国家利益和公共利益之外,不应该代表自己的利益,但现实生活中部门利益、地方利益等政府利益客观存在,而且还大量存在政府假借"公共利益"之名谋取自身利益甚至个人利益的情况。通常而言,公共利益是上位概念,国家利益是下位概念,但二者在主体、性质、内容、范围等方面不尽相同。集体利益是一个"圈子"内的共同的利益,其与公共利益的最根本的区别在于,这个"圈子"是封闭的,而不是开放的。要重塑公共利益观,加强公共利益的理论研究,从应然层面界定公共利益;同时,要加强公共利益的立法技术研究,从实然层面界定公共利益,并努力使公共利益的实然表达与应然表达相契合,指导我国公共利益的立法、执法和司法实践。Traditionally,China has been emphasizing national interests,collective interests,ignoring personal interests and public interest.Obligatorily speaking,in addition to national interests and public interests,governments should not represent their interests,but in real life sector interests,local interests and other interests of the government exist objectively,and there are many phenomena of government pursuit of their own interests against public interests.Usually,public interest includes national interest,but both differ from each other in the subject,nature,content,scope and other aspects.Collective interest is a'circle'in the common interests,whose most fundamental difference from public interest is that this'circle'is closed,not open.To reshape the view of public interest,we should strengthen public interest theory study,define public interest from the obligatory level;at the same time,we should strengthen research study of public interest legislation,define public interest,and make efforts to make public interest fit to the real one to guide our public interest practice.
