摘　　要：长期以来,社会各界对公共图书馆是否合法享有与行使处罚权(尤其是罚款权)问题存在颇多争议,处罚行为至今仍在一定程度上制约着图书馆科学管理,影响着图书馆的社会形象。通过总结分析学术研究中对图书馆处罚权的不同观点,从公共图书馆法律地位与职能的角度阐述其在现行法律制度框架内享有的处罚权,并就权力的规范化行使问题进行思考。For a long time people have been arguing about whether public libraries legally own the right to punishment, especially about whether fines shall be imposed. To some extent, the punishment behaviors have been a deterrent to the scientific management of a library, and negatively affected the social images of public libraries. Based on the summary on various diversified viewpoints on the disciplinary punishment power of public libraries, this paper discusses about the punishment power of a public library conferred by law from the perspective of its legal position and function as well as the normative exertion of economic disciplinary powers.
