论我国环境警察权产生和存在的基础

摘　　要：我国环境警察权有其产生和存在的基础。政策支持、现实需要、国内实践及域外经验构成了我国环境警察权产生和存在的现实基础;警察权理论和环境权理论构成了我国环境警察权产生和存在的直接理论基础;我国现有法律中有关公安机关部分的环境管理及环境执法权是我国环境警察权存在的法律基础。而我国环境警察权体系的最终形成还需要理论研究的支撑及相关立法进行合理配置和系统明确的规定。China＇s environmental police power has emerging and existing bases, among which policy support, practical needs and the practical experiences at home and abroad constitute the realistic basis, while theories of police power and environmental rights constitute the theoretical basis. In current laws, the environmental management and enviromnental enforcement power relaled to public security organs are legal bases for the ex stence of enviromnental police power in China. But the establishment of a complete system of environmental police power calls for the support of theoretical research as well as rational allocation and explicit stipulations in relevant legislation.
