摘 要:成都市涉诉信访的法治化路径选择,是推进"平安城市、法治城市"两大建设的重要前提和保障。要做好这方面的工作,必须首先厘清和明确三个问题,即涉诉信访的概念及功能定位、申诉和再审程序进一步细化与规范以及信访案件效度评估机制。鉴于成都市涉诉信访的现状,其法治化路径的选择还应从多个方面着手。一是规范法治理念下的涉诉信访制度;二是完善涉诉信访的终结机制,使司法的最终裁决权得到体现和保证;三是完善与党政机关的衔接和协调机制;四是完善司法救助制度和社会保障制度;五是健全涉诉信访的秩序保障机制;六是提升司法公正,提高案件质量;七是深入基层,加强检察监督和法治宣传。To the government of Chengdu, legal path choice of petition involved litigation is important premise and guarantee for the two conctruction of "Safe City and Running City by Law”. To do this work well, we must first clarify and define the three problems, namely, the concept and function orientation of petition involved litigation, further elaboration and specification of appeal and retrial procedure, and standardization of evaluation mechanism. In view of the status of petition involved litigation of chengdu, the path choice should observe the following rules: first, it is to standardize the petition involved litigation system in the concept of the rule of law;secondly, to improve the mechanism, and guarantee the final judicial decisions; thirdly, to perfect cohesion and coordination mechanism between the Party and government organs ; fourthly, to improve the judicial assistance system and the social security system; fifthly to improve the guarantee mechanism of petition involved litigation;sixthly to promote judicial justice and improve the quality of the case; and at last, to strengthen the procuratorial supervision and the rule of law of the grass-roots level.
