摘　　要：作为一种文化现象,司法权威取决于人们对司法主体的文化定位、司法过程的文化认同和司法结果的文化支持。司法主体权威的内涵、能量和界限取决于司法角色的文化定位、司法功能的文化期待和司法管辖范围的文化选择;司法活动是寻找事实和寻求法律的文化认识、文化评价和文化选择的过程,其权威根源于文化认同,来自于文化共识,立基于文化解释。司法裁判的权威深受人们诉讼观念的影响,尊重司法结果的文化意识是司法权威确立的前提,认同司法结果的文化取向是司法权威的基础,支持司法最终解决的文化理念是司法权威的支撑。只有给法官能够独立思考和判断的空间,只要对司法机关作出的事实判断、法律解释、司法立法给予足够的尊重、理解和支持,法官才能摆脱外在的各种压力,真正走向自治和自强,从而不断地提升司法的权威性。Judicial process is the judge use reason and experience to decide cases, interpreting legal public rational, and it is the process of a lot of program participants through debating and communicating the facts and norms for significance construction. As a kind of cultural phenomenon,the judicial authority depends on people＇s cultural orientation to the judicial body, the judicial process of cultural identity and the result of cultural support. The judicial authority, its connotation, energy and boundary of authority depends on the cultural location of their judicial role, the cultural expectations of judicial function and the cultural choice of judicial limits. Judicial activity is the process of cultural knowledge, evaluation and selection searching for facts and seeking laws. Judicial authority roots in the cultural identity, consensus and is based on cultural ex- planation. The authority of the judicial referee is heavily influenced by people＇s lawsuit concept. The cultural awareness re- specting .the judicial results is the precondition of judicial authority establishment. The cultural orientation to identify judicial results is the basis of the judicial authority. The cultural concept to support the judicial final settlement is the support of ju- dicial authority. Short of the social cultural consciousness and cultural ideas for knowledge, understanding and respect for ju- dicial, the justice is impossible to establish the supreme authority in social life, Only giving judge more spaces of independ- ent thinking and judgment, as long as to the judicial organs of fact judgment, legislative interpretation and judicial legisla- tion will be given enough respect, understanding and support, thus the judge could surpass external pressure, really close to autonomy and self- improvement, and then the judicial authority will be constantly improved.
