参合农民的监督参与权相关法律问题研究

摘　　要：参合农民享有的对新型农村合作医疗各项事务的参与管理权、参与监督权和知情权已经在中央政策文件和地方立法中予以明确,并通过一系列的制度安排予以保障。这三项权利的行使,有助于实现对新型农村合作医疗的有效监督,提高农民的参与意识和主体地位,促进新型农村合作医疗管理决策和管理的民主化和科学化。但在实践中,由于农民参与意识的薄弱、制度设计的过于原则以及医疗卫生服务的特殊性,使得参合农民监督参与权的行使流于形式。应当建立和完善参合农民的自治组织,健全参合农民参与管理新型农村合作医疗的程序制度和强化参合农民参与新型农村合作医疗事务监督管理的激励机制来保证参合农民行使监督参与权。Peasants participating new rural cooperative medical system have the supervision and right to know the affairs of new rural cooperative medical care system. The rights have been adimitted by the central policy documents and local legislation. Exercise the three rights contributing to promote the realization of effective supervision, raise the peasants ＇participation consciousness and main body status, to promote new farmers in democratization and scientific process of management decision and management. But in practice, because the farmers participation consciousness is weak, and the principles of system design is too particularity make accounting supervision and participation by peasants become a mere formality. It needs to establish and perfect the peasants＇s autonomous organization, improve the accounting for peasants to participate in the management of new rural cooperative medical system and strengthening of ginseng to peasants involved in new rural cooperative medical sustem and regulatory incentives to ensure that peasants ginseng to exercise the supervision and participation.
