摘　　要：《人民人民检察院组织法》是构建我国检察制度的法律基础,检察职权的科学设置是《人民检察院组织法》修改的核心内容。由于历史的局限和立法固有的滞后性,现行《人民检察院组织法》关于检察职权的规定与目前检察机关实际履行的职权存在很多脱节之处。改革和完善检察职权应当通过对《人民检察院组织法》相关条款的缜密设计和合理整合建立检察职权的科学体系:在结构体例上另设专章规定检察职权;在法律衔接上理顺与相关法律的调整对象和范围;在内容规范上按照功能性职权和结构性职权结合的立法模式规定具体的检察权能和监督措施。The procuratorate organization law is the legal basis of constructing of the procura- torial system of our country, the scientific construction of procuratorial authority is the core con- tent of modified procuratorate organization law. Because of the inherent defect and legislation lag defect, provisions concerning the procuratorial authority of the procuratorate organization law has a lot of department from the actual performance. To reform and perfect the procuratorial authority shall establish the procuratorial authority through careful design and reasonable integration of the relevant provisions of the law of the people＇ s Procuratorate ： Chapter setting the procuratorial au- thority on structural style; straighten out the legal adjustment object in cohesion and related legal and scope; legislative model based on content standards in accordance with the functional author- ity and the structural power of procuratorial authority and specific measures of supervision.
