摘　　要：在阐述药品缺陷的概念和探讨药品缺陷损害案件法律适用的基础上,从法律责任角度,结合实际生活现状,并针对在司法实务中药品缺陷损害案件处理存在的药监部门责任弱化、受害人举证困难、无过错责任原则加重医疗机构负担、医疗机构使用药品行为定性等问题,提出加强公民对国家赔偿的法律意识、设置药品缺陷损害技术鉴定机构、建立药害救济金和药品责任险、完善立法等措施,使我国药品缺陷损害案件的处理结果更加公平、公正。This paper states the conception of defects of drug and the application of law of cases which are damaged by defects of drug. Stud- ies on some problems in judicial practice which exist the cases of defects of drug, weakened liability of the drug administration department, the difficulties of proof of the victim, the principle of no - fault liability aggravates the burden of medical institutions, the nature of the behavior about medical institutions use the drugs and so on from the point of view of legal responsibility and combines with the actual situation of life. Put forward to enhancing people~ legal awareness of national compensation, setting identification of case for injury by defective drugs, establishing tile system of relief payment of phytotoxicity and medical liability insurance, perfect the legislation and other pertinent suggestions, make the processing re- suits of our country~ cases which are damaged by defects of drug fairer and justice.
