摘　　要：理解TRIPS协定第三十九条第三款中未披露试验数据的反不正当竞争保护,需要正确分析该条款与第三十九条第一款中援引的《巴黎公约》第十条之二的关系。第三十九条第三款既有其权利义务的独立性,又存在与《巴黎公约》第十条之二的关联性。在解释TRIPS协定第三十九条第三款的"不公平商业使用"时,不应按照《巴黎公约》理解为"违背诚实的商业活动",但在判断政府使用数据的动机方面,应当以《巴黎公约》提出的"反不正当竞争"的精神为标准。The third item under article thirty-nine of the Paris Convention covers some data undisclosed about the effective protection against unfair competition. In order to understand those data, the first item under article thirty-ninth and its relation with the second item under article ten should be studied. The third item enjoys its independence of rights and duties but at the same time it is closely related to the second item under article ten. The phrase ＂unfair commercial use＂ in the third item under article thirty-nine should not be interpreted as ＂anti-honesty commercial activity＂ as is written in the Paris Convention; rather, it should be understood in correspondence with the principle of Paris Convention, which is the protection against unfair competition.
